Welcome to Luxembourg Expats. These Terms of Service ("Terms") are a binding agreement between you and Flywheel Global SARL-S, a simplified private limited liability company registered in Luxembourg ("we", "us", "our"). By creating an account, using the website, or using the mobile app you agree to these Terms. If you don't agree, don't use the service.
1. The service
Luxembourg Expats is a community platform for expats in Luxembourg and nearby regions. It lets you:
- Post and browse listings (housing, buy & sell, jobs, events, offers, stories).
- Discover and contact local businesses.
- Join the "Meet People" community to find others with shared interests.
- Chat with other members directly or in groups.
- Subscribe to optional paid features (Club Membership, Featured Listings).
The service is provided "as is". Features, sections, and pricing may change over time — we try to announce material changes in advance.
2. Your account
- You must be 18 or older. The Meet People section in particular is not intended for anyone under 18, and creating an account to misrepresent your age is a violation of these Terms.
- You're responsible for your account credentials and for everything that happens under your account. If you suspect unauthorised access, change your password and email team@luxexpats.lu.
- Give us accurate information when you sign up and keep it up to date in your profile. Impersonating another person or creating fake accounts isn't allowed.
- One person, one account. If we close your account for breaching these Terms, don't create a new one.
3. Content you post
You own the content you post (photos, bios, listings, messages, comments, stories — "Your Content"). By posting, you grant Flywheel Global SARL-S a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify (for formatting / thumbnails), and display Your Content on the service, for as long as you keep it on the service. This licence ends when you delete the content or your account, except for:
- Copies another member has already saved or forwarded.
- Backups we retain briefly for disaster-recovery purposes.
You promise that Your Content:
- Is yours to post, or you have permission from whoever owns it.
- Doesn't break the law, infringe anyone else's rights, or violate the prohibited-content rules below.
4. Community rules — what's not allowed
Don't use the service to post, send, or promote:
- Harassment, hate speech, threats, or bullying of any person or group.
- Sexual content involving minors, non-consensual intimate imagery, or any content that exploits or endangers children.
- Illegal goods or services (drugs, stolen items, weapons, counterfeits).
- Scams, phishing, pyramid schemes, unsolicited commercial spam, or misleading "too good to be true" offers.
- Malware, viruses, or attempts to break into the platform or other accounts.
- Content that infringes copyright, trademark, or other intellectual-property rights.
- Private personal information about anyone else without their consent.
- Impersonation of Luxembourg Expats, its staff, or other members.
We moderate content both proactively and in response to user reports. Under the EU Digital Services Act, you have the right to be told when we remove your content and why, and to appeal the decision. To appeal, reply to the removal notice or email team@luxexpats.lu.
5. Marketplace listings (Buy & Sell, Real Estate, Events, Jobs, Offers)
- Listings are between members. Flywheel Global SARL-S is not a party to the transaction — we provide the platform, you deal directly with the other person.
- Meet in a public place, check goods before paying, and never send money to someone you haven't verified. We don't vet listings and can't guarantee condition, ownership, or delivery.
- Prohibited items include anything illegal under Luxembourg law plus: firearms, drugs, counterfeit goods, live animals (except via regulated channels), human remains, and anything listed in category 4 above.
- Disputes between members: try to resolve directly first. If you can't, you can report the other party to team@luxexpats.lu and we may mediate or, for serious cases, suspend the account involved.
6. Meet People
- Members are not identity-verified. Use normal safety precautions — meet in public, tell a friend where you're going, don't share financial information with people you've just met.
- Report profiles that seem fake, abusive, or impersonate someone — the three-dot menu on any card / profile, or email us directly.
- Premium Club Membership changes discoverability and messaging rules but doesn't verify identity.
7. Paid subscriptions & listings
- Payments are processed by Stripe. We don't see or store your card details.
- Subscriptions (e.g. Club Membership) renew automatically on the cycle you chose (monthly / yearly) until you cancel. Cancel any time from Settings → Subscriptions; your access continues until the end of the paid period.
- EU right of withdrawal. If you're a consumer in the EU, you have 14 days from the start of a subscription to withdraw. Because paid features grant immediate access to digital content, by starting a paid plan you acknowledge that you expressly request immediate performance and lose the withdrawal right once access begins. Contact team@luxexpats.lu if you believe an exception applies.
- Featured / promoted listings (Real Estate, Local Business) are one-off paid placements; they don't auto-renew.
- Refund disputes: email us first — we handle most within 5 business days. Stripe's dispute process remains available to you as a card holder.
- Prices shown include VAT where applicable.
8. Elso — AI assistant
The service includes "Elso", an AI-powered assistant accessible through a chat interface ("Elso" or "AI Features"). You agree that:
- No professional advice. Elso's responses are generated by a machine-learning model and may be inaccurate, incomplete, outdated, or misleading. They are not legal, medical, financial, tax, immigration, psychological, or any other form of professional advice and must never be relied on as such. Always verify with a qualified professional before acting on anything Elso tells you.
- No warranty, no liability. Flywheel Global SARL-S makes no representation or warranty as to the accuracy, completeness, suitability, or fitness for any purpose of output generated by Elso, and to the maximum extent permitted by law accepts no liability for any loss, damage, or consequence arising from your use of Elso or any third-party reliance on Elso's output. This exclusion applies regardless of whether the output was triggered by a prompt you wrote, another member's input, or an automated process.
- Model providers. Elso is powered by third-party large-language-model providers. Your prompts and messages are transmitted to and processed by those providers to generate responses. See our Privacy Policy for the current list of sub-processors and what happens to the data.
- Don't submit sensitive data. Do not send Elso government ID numbers, bank details, card numbers, medical records, passwords, or other confidential information you wouldn't share with a stranger. You're responsible for everything you paste into the AI.
- Acceptable use. Don't use Elso to generate content that would violate these Terms if you posted it yourself (harassment, illegal content, infringement, fraud, malware, etc.), to reverse-engineer the underlying model, to compete with Flywheel Global SARL-S, or to re-publish Elso's output as your own professional advice. You are solely responsible for any downstream use of Elso output.
- Improvement of the service. We may use anonymised, aggregated AI interactions to evaluate quality and improve prompts. We will not sell your AI conversations. Where our model provider retains data for their own abuse detection, this is governed by their terms, referenced in our Privacy Policy.
- Availability. Elso is offered on a best-effort basis. We may disable, limit, or change it at any time — including per-user rate limits — without notice and without liability.
9. Our intellectual property
The Luxembourg Expats name, logo, branding, site design, software, Elso, and all related materials are owned by Flywheel Global SARL-S or our licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the service for its intended personal, non-commercial purpose. You can't copy, modify, distribute, sell, lease, reverse-engineer, scrape, or create derivative works from any part of the service without our prior written permission.
10. Suspension & termination
- You can delete your account at any time. See how to delete your account.
- We may suspend or close an account that breaks these Terms, is a safety risk to others, or generates repeated policy-compliance complaints. We'll tell you why, and you can appeal.
- Ongoing paid subscriptions will either be cancelled and prorated where required by law, or forfeited if the account is closed for serious violations (fraud, illegal content, repeat offences).
11. Warranties & disclaimer
To the maximum extent permitted by applicable law, Luxembourg Expats and Elso are provided "as is" and "as available", with all faults and without warranty of any kind, whether express, implied, statutory, or otherwise. We specifically disclaim any warranty of merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, accuracy, reliability, security, or uninterrupted operation.
We make no representation or warranty that:
- Content posted by members is accurate, lawful, safe, or suitable for you.
- Other members are who they claim to be, or that any interaction, meeting, transaction, listing, or message will meet your expectations.
- The service will be free from errors, bugs, viruses, interruptions, data loss, or unauthorised access.
- AI Features (Elso) will produce accurate, useful, or harmless output.
12. Limitation of liability
To the maximum extent permitted by applicable law, in no event will Flywheel Global SARL-S, its affiliates, officers, directors, employees, contractors, agents, or licensors be liable for any:
- Indirect, incidental, consequential, special, exemplary, or punitive damages (including loss of profits, revenue, business, goodwill, data, or opportunity);
- Loss or damage arising from content posted by, or conduct of, any member or third party;
- Loss or damage arising from your reliance on Elso or on any information obtained through the service;
- Loss or damage arising from unauthorised access to, or alteration of, your account or Your Content; or
- Any claim relating to listings, transactions, meetings, or other interactions between members (we are not a party to those).
Our total aggregate liability to you for all claims arising out of or relating to the service, whether in contract, tort, statute, or otherwise, is capped at the greater of (a) the total fees you paid us in the twelve (12) months immediately before the event giving rise to the claim, or (b) fifty euros (€50). Multiple claims do not increase this cap.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under Luxembourg law — including liability for fraud, wilful misconduct, gross negligence, or death or personal injury caused by our negligence — or statutory consumer rights that cannot be waived.
13. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Flywheel Global SARL-S and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your breach of these Terms or any policy referenced in them;
- Your use of the service, including listings you post, messages you send, meetings you arrange, and transactions you enter into with other members;
- Your use of Elso or any downstream use or publication of Elso's output;
- Your violation of any law or the rights of any third party (including IP rights).
We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you; you agree to cooperate with our defence of such claims.
14. Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, pandemic, government action, labour disputes, utility or network outages, or failures of upstream providers (hosting, payments, OAuth, AI model providers).
15. Governing law & disputes
These Terms are governed by the laws of the Grand Duchy of Luxembourg, without regard to conflict-of-law rules. The courts of Luxembourg City have exclusive jurisdiction, except that consumers keep any mandatory rights to bring proceedings in the courts of their country of residence.
16. General
- Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy, and any additional terms that apply to a specific feature (e.g. Club Membership), form the entire agreement between you and Flywheel Global SARL-S.
- Severability. If any provision is held unenforceable, the rest of these Terms continue in full force.
- No waiver. Our failure to enforce any right is not a waiver of that right.
- Assignment. You may not assign or transfer these Terms. We may assign them to an affiliate or to a successor in connection with a merger, acquisition, or sale of assets.
- No third-party beneficiaries. No one other than you and us has rights under these Terms.
- Language. The English version of these Terms is the authoritative version; translations are for convenience only.
17. Changes to these Terms
We may update these Terms occasionally. Material changes will be announced in-app or by email, with at least 14 days' notice where practical. Continued use after the effective date means you accept the new Terms.
