Fresh Start: “Right to Be Forgotten” Improves Loan Access

Luxembourg is introducing a significant reform in consumer credit with the implementation of the “right to be forgotten,” aimed at improving access to loans for individuals who have recovered from serious illnesses. This measure addresses long-standing concerns about financial discrimination faced by former patients, particularly those who continue to be penalized for past health conditions despite full recovery.

Under the new framework, lenders will no longer be allowed to take certain past medical conditions into account after a defined period. This means that individuals who have successfully overcome illnesses will have a fairer chance of obtaining loans, mortgages, or other forms of credit. The policy is designed to reflect a person’s current situation rather than outdated health records.
